Amiibos are just figures with a NFC chip inside (at the bottom). Amiibo spoofing is just using the same NFC chips that amiibos use by themselves. The switch doesn't check for authenticity and they aren't complicated code wise. So they are safe and not bannable. You can use joycon droid unless the game requires you to write your amiibo, then you need to use an nfc tag.
